Quick question · Annulment

Can I get my marriage annulled if it was never consummated?

Answered by Updated

Short answer

Yes, non-consummation, whether due to one party's incapacity or wilful refusal, is one of the recognised grounds for a voidable marriage to be annulled under the Women's Charter. Unlike other voidable grounds, there's no strict three-year filing deadline for non-consummation cases, though you will still need to provide credible evidence to the court to support your claim.
